GBENGA GBADESIRE TAKES ON IKOYI CLUB

There seems to be a large rent in the otherwise beautiful apparel of the prestigious Ikoyi Club 1938, as an ex- member has dragged the elite club before Justice K.O. Dawodu of the  High Court, Igbosere, Lagos.

The plaintiff, Gbenga Gbadesire, has sued the Club for the sum of N100m( One hundred million naira) for  allegedly infringing on his fundamental human rights as well as his unjust expulsion from the Club.
Though the court had fixed Monday, June 29 for judgment, it could, however, not be delivered, as Justice Dawodu was said to be on a “national assignment.

Gbadesire, a former chairman, Entertainment of the club( 2006 to 2008), is contesting his expulsion from the club, via a letter dated October 2, 2008, on the grounds that it was not procedural and constituted a breach of Rule 9 of the Ikoyi Club 1938 Rules 2007.
The claimant said he was made to face the disciplinary sub-committee of the club on August 14, 2008, on account of some allegations levelled against him by one Kole Jagun who accused him(Gbadesire) of acting contrary to Rule 38 (c) and (d) of the club.
This allegation and his subsequent summon by the sub-committee, eventually led to his suspension from the club for a period of one year via a letter dated August 27, 2008.

Society Happenings gathered that he was informed about his expulsion through a letter dated October 2, 2008,  following a meeting of the registered trustees of the club on September 23, 2008.
Consequently, Gbadesire is insisting that the decision to expel him from the club was a violation of his fundamental human rights to fair hearing and principle of natural justice as enshrined in Section 36 and of the 1999 Constitution.
He is also praying the court to declare his expulsion malicious and a flagrant abuse of his right to the freedom of association as protected by Section 40 of the Constitution.
